1. Scope of this policy
This policy explains how YAMAN SOUND processes personal data when you use yamansound.eu, contact YAMAN SOUND, submit booking or rental enquiries, subscribe to the newsletter, use Facebook or Instagram lead forms, or attend YAMAN SOUND events.
The controller’s identification and contact details are shown at the top of this page. Where YAMAN SOUND is used as a trading or project name, the controller is the specific individual or legal entity identified as the operator.
2. Personal data we may process
Depending on how you interact with us, we may process in particular:
- first and last name,
- email address and phone number,
- information included in an enquiry or message,
- information required for a booking, rental, invoicing or performance of a contract,
- information you voluntarily submit through Meta/Facebook/Instagram lead forms,
- newsletter subscription information and consent records,
- technical information necessary for the secure operation of the website and services,
- photographs and video recordings from events where a person is identifiable.
We do not request special categories of personal data unless this is necessary and lawful in a specific situation.
3. Purposes and legal bases
Contact and booking enquiries. We use the information to respond, discuss cooperation and take steps before entering into a contract. The legal basis is primarily performance of a contract or pre-contractual steps and, where appropriate, our legitimate interest in handling communications.
Rental, merchandise and other orders. We process data to arrange reservations, equipment handover and return, orders, payments, complaints and related administration. The legal bases are performance of a contract, pre-contractual steps and compliance with legal obligations such as accounting and tax requirements.
Newsletter. We use your email address to send YAMAN SOUND, event, YAMAN Recordings, merchandise and related news where we have an appropriate legal basis, typically your consent. You can withdraw consent at any time using the unsubscribe link in every newsletter. Withdrawal does not affect the lawfulness of processing carried out before withdrawal.
Meta / Facebook / Instagram lead forms. If you submit a lead form, we process only the information requested by that form or voluntarily provided by you. The specific purpose is stated in the form, for example an event, rental or partnership enquiry or marketing communications. Depending on the form, the legal basis may be consent or steps taken before entering into a contract. Meta also processes data under its own terms and privacy policies.
Event photography and video. We may create documentary and promotional material at events. Where this involves personal data, the legal basis will depend on the circumstances and may include our legitimate interest in documenting and presenting events or consent where required. This does not affect separate rights relating to image and privacy.
Website security and operation. Necessary technical data may be processed to secure the website, prevent abuse and resolve technical issues on the basis of our legitimate interests.
4. Newsletter and Kit
Our newsletter is technically provided through Kit. Kit may process on our behalf information such as your email address, subscription information and technical delivery data. Where double opt-in is used, the subscription is completed only after you confirm the link sent to your email address.
You can unsubscribe at any time using the link in an email or by contacting YAMAN SOUND.
5. Recipients of personal data
Where necessary, data may be shared with providers that help us operate our website and services, including:
- our newsletter infrastructure provider (Kit),
- Meta in connection with Facebook, Instagram and lead forms,
- hosting, domain and network infrastructure providers used by the website,
- accounting, tax or legal advisers where necessary,
- suppliers involved in a specific order or event where necessary to provide the service,
- public authorities where disclosure is required by law.
If you purchase a ticket through an external ticketing platform, that platform may process your data as an independent controller under its own terms. If it subsequently provides us with data necessary to organise the event, we process that data under this policy.
6. Transfers outside the EEA
Some technology providers may process data outside the European Economic Area. Where this occurs, transfers must rely on mechanisms recognised by applicable data protection law, such as an adequacy decision or Standard Contractual Clauses where required.
7. Retention
We keep personal data only for as long as necessary for the relevant purpose:
- ordinary contact and booking enquiries are generally retained for no longer than 24 months after the last relevant communication, unless a contract or another reason for longer retention arises,
- contract, payment, rental and accounting data are retained for the duration of the relationship and then for the period required by law or necessary to protect legal claims,
- newsletter data are retained until you unsubscribe or withdraw consent; a limited record of consent or withdrawal may be kept for longer where necessary to demonstrate compliance,
- Meta lead form data are generally retained for no longer than 24 months, unless the enquiry develops into a contractual relationship or another legal basis applies,
- photographs and video are kept for as long as they retain reasonable documentary or promotional value, subject to periodic review.
8. Cookies and local storage
The website may use technical mechanisms necessary for its operation. For example, your language choice is stored locally in your browser so the website can remember your preference. External services loaded on certain pages may use their own technical means under their respective policies.
If analytics, advertising pixels or other non-essential tracking technologies requiring consent are added in the future, the consent mechanism and this policy will be updated accordingly.
9. Your rights
Depending on the processing, you may have the right to:
- receive information and access your personal data,
- request correction of inaccurate data,
- request erasure where the legal conditions are met,
- request restriction of processing,
- receive data in a portable format where applicable,
- object to processing based on legitimate interests,
- withdraw consent at any time where processing is based on consent,
- lodge a complaint with the Czech Office for Personal Data Protection (ÚOOÚ).
You can submit a request using the contact email shown at the top of this page. We may reasonably verify your identity to prevent disclosure of data to an unauthorised person.
10. Automated decision-making
YAMAN SOUND does not carry out automated individual decision-making that produces legal or similarly significant effects, unless you are specifically informed otherwise in connection with a particular service.
11. Security
We use reasonable technical and organisational measures to protect personal data against unauthorised access, alteration, loss or misuse. No internet transmission can, however, be guaranteed to be absolutely secure.
12. Changes to this policy
We may update this policy when our services, tools or legal requirements change. The current version will always be published on this page together with the date of the latest update.
